Sold a returned product as new

Disappointing, the security seals were broken on the box. This was a returned product and should have been indicated as such. Is it OK or damaged? Vortex does have a great warranty, but this is a Limited Distribution product so repair or replacement??? Does not appear to have been installed, but a battery was loaded in the scope. I have never seen an optic packaged with the battery already installed. A new battery in the package was in the box. Unusual.

It should have been clearly indicated this was a returned product when purchased.
